1. Acceptance of these terms

These Terms & Conditions (“Terms”) are an agreement between you and Kodonic Digitech Private Limited (“Kodonic Games”, “we”, “us”) governing your use of Battleship: Naval Fleet Battle (“the Game”), including any updates, online features and in-game content.

By downloading, installing or playing Battleship: Naval Fleet Battle, you agree to these Terms and to our Privacy Policy. If you do not agree, do not download or use the Game.

App store terms

Your use of the Game is also subject to the terms of the store you downloaded it from (the Apple Media Services Terms and Conditions or the Google Play Terms of Service). If you downloaded the Game from the Apple App Store, you acknowledge that these Terms are between you and us only, not Apple; that Apple has no obligation to provide maintenance or support for the Game; that Apple is not responsible for addressing any claims relating to the Game; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

2. Eligibility and age

Battleship: Naval Fleet Battle is rated Everyone. You must be at least 13 years old (or the higher minimum age required in your country) to use the Game. If you are under the age of majority where you live, you may use the Game only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Game, including any purchases.

3. License to use the Game

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download, install and play Battleship: Naval Fleet Battle for your own non-commercial entertainment, on devices you own or control, as permitted by the usage rules of the store you obtained it from.

You may not, and may not help anyone else to:

• copy, modify, translate, sell, rent, lease or distribute the Game or any part of it;
• reverse engineer, decompile or disassemble the Game, except where the law expressly allows it;
• use cheats, bots, automation, modified clients or exploits, or intentionally abuse bugs;
• circumvent any technical protection or access-control measures; or
• use the Game for any commercial purpose or in any way that breaks the law.

4. User accounts

Online features of Battleship: Naval Fleet Battle require a free account (Email and password or Continue with Google). You can play offline without one. You must give accurate information when you sign up. Display names and handles are visible to other players. You are responsible for keeping access to your account and device secure and for all activity that happens under your account. Tell us straight away at support@kodonic.com if you think your account has been misused.

Accounts are personal to you and may not be sold, shared or transferred. You can delete your account at any time; see our account deletion page.

5. User conduct

When using the Game, you agree not to:

• break any applicable law or infringe anyone else’s rights;
• choose a player name that is offensive, misleading or impersonates someone else;
• harass, threaten, abuse or discriminate against other people;
• attempt to gain unauthorised access to our systems, other players’ accounts or data;
• interfere with or disrupt the Game, its servers or networks, or upload malware; or
• scrape, data-mine or otherwise collect information from the Game by automated means.

6. Intellectual property

The Game and all of its content, including software, graphics, artwork, audio, text, characters, names and logos, are owned by or licensed to Kodonic Digitech Private Limited and protected by copyright, trademark and other laws. All rights not expressly granted to you in these Terms are reserved. If you send us feedback or suggestions, you allow us to use them without any obligation to you.

7. Third-party services and links

Battleship: Naval Fleet Battle uses third-party services (for example, for advertising, analytics or sign-in) and may display third-party ads or links. We are not responsible for third-party services, content or websites, and your use of them is governed by their own terms and privacy policies.

8. Termination

You may stop using Battleship: Naval Fleet Battle at any time by uninstalling it and, if you wish, deleting your account. We may suspend or terminate your access to the Game or any online feature if you seriously or repeatedly break these Terms, if required by law, or if we discontinue the Game. Where reasonable, we will give advance notice. On termination, your license ends and you must stop using the Game; sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

9. Disclaimers

The Game is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the Game will be uninterrupted, error-free or available on every device. We may update, change or remove features or content, and may discontinue online features or the Game.

10. Limitation of liability

To the fullest extent permitted by law, Kodonic Digitech Private Limited and its directors, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or virtual items, arising from or related to your use of the Game.

Our total liability for all claims relating to the Game is limited to the greater of INR 5,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.

11. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to the paragraph below, the courts at Bhopal, Madhya Pradesh, India have exclusive jurisdiction over any dispute arising from these Terms or the Game.

If you are a consumer living in another country, you also benefit from any mandatory protections of the law of your country of residence, and you may be entitled to bring proceedings in your local courts. Before starting formal proceedings, please contact us at support@kodonic.com so we can try to resolve the issue informally.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, for material changes, give you notice in the Game or by other reasonable means before they take effect. If you keep using the Game after the changes take effect, you accept the updated Terms.
