1. Acceptance of these terms

These Terms & Conditions (“Terms”) govern your use of games.kodonic.com (“the Website”), operated by Kodonic Digitech Private Limited (“Kodonic Games”, “we”, “us”). By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

Each of our games has its own Terms & Conditions that apply when you play it:

2. User conduct

When using the Website, you agree not to:

• break any applicable law or infringe anyone else’s rights;
• harass, threaten, abuse or discriminate against other people;
• attempt to gain unauthorised access to our systems, other players’ accounts or data;
• interfere with or disrupt the Website, its servers or networks, or upload malware; or
• scrape, data-mine or otherwise collect information from the Website by automated means.

3. Intellectual property

The Website and all of its content, including software, graphics, artwork, audio, text, characters, names and logos, are owned by or licensed to Kodonic Digitech Private Limited and protected by copyright, trademark and other laws. All rights not expressly granted to you in these Terms are reserved. If you send us feedback or suggestions, you allow us to use them without any obligation to you.

4. Third-party services and links

The Website links to third-party sites, such as the Apple App Store and Google Play. We are not responsible for third-party services, content or websites, and your use of them is governed by their own terms and privacy policies.

5. Termination

We may suspend or restrict access to the Website at any time, for example for maintenance or if you break these Terms.

6. Disclaimers

The Website is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee that the Website will be uninterrupted, error-free or available on every device.

7. Limitation of liability

To the fullest extent permitted by law, Kodonic Digitech Private Limited and its directors, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or virtual items, arising from or related to your use of the Website.

Our total liability for all claims relating to the Website is limited to the greater of INR 5,000.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.

8. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to the paragraph below, the courts at Bhopal, Madhya Pradesh, India have exclusive jurisdiction over any dispute arising from these Terms or the Website.

If you are a consumer living in another country, you also benefit from any mandatory protections of the law of your country of residence, and you may be entitled to bring proceedings in your local courts. Before starting formal proceedings, please contact us at support@kodonic.com so we can try to resolve the issue informally.

9. Changes to these terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, for material changes, give you notice by other reasonable means before they take effect. If you keep using the Website after the changes take effect, you accept the updated Terms.
